Welcome to MILD FRENZY LIMITED ("we," "us," or "our"). By accessing or using our website ressada.com (the "Site") and our AI-powered insight generation tool (the "Service"), you ("you" or "User") agree to be bound by these Terms of Service ("ToS"). If you do not agree to these ToS, you may not access or use the Site or Service.

2. Description of Service

MILD FRENZY LIMITED provides an AI-powered tool that generates insights from unstructured text data. Users can upload or provide text data, and our AI models, powered by Google Gemini API, will analyze the data to identify key themes, patterns, and trends.

3. Account Registration

To use the Service, you must register for an account. You agree to provide a valid email address through Clerk, our authentication provider, and to keep your account information accurate and up-to-date. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized access to or use of your account.

4. Acceptable Use

You agree to use the Site and Service in accordance with all applicable laws and regulations. You agree not to:

  • Use the Site or Service for any illegal or unauthorized purpose.
  • Upload or transmit any content that is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable.
  • Attempt to interfere with the operation of the Site or Service, including by hacking, distributing viruses, or engaging in denial-of-service attacks.
  • Attempt to circumvent any security measures or access controls.
  • Scrape or otherwise extract data from the Site or Service without our express written permission.
  • Use the Service in a way that violates the privacy of others.
  • Violate any usage limits or restrictions that we may impose.
  • Use the service to generate insights that are used for discriminatory purposes.
  • Reverse engineer, decompile, or disassemble the Service.

5. Intellectual Property

Your Content: You retain ownership of the text data you upload or provide to the Service ("Your Content"). By uploading or providing Your Content, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display Your Content for the purpose of providing and improving the Service. This includes using your content to train and improve our AI models.

AI-Generated Insights: The AI-generated insights provided by the Service are owned by you, the User. You may use the AI-generated insights for your own purposes, subject to these ToS.

Our Intellectual Property: The Site and Service, including all software, algorithms, designs, and trademarks, are owned by MILD FRENZY LIMITED or its licensors and are protected by intellectual property laws. You may not use our intellectual property without our express written permission.

6. Data Scrubbing and Accuracy of AI Insights

We make best efforts to scrub private information from the data you upload and to provide accurate AI-generated insights. However, we cannot guarantee that all personal information will be removed or that the AI-generated insights will be completely accurate or reliable. You are solely responsible for verifying the accuracy and completeness of the AI-generated insights before relying on them. You acknowledge that the AI-generated insights are based on complex algorithms and may be subject to errors or biases.

7. Use of Google Gemini API

You acknowledge that the Service relies on the Google Gemini API. Your use of the Service is subject to Google's terms of service and privacy policy for the Gemini API. We are not responsible for any issues or disruptions caused by Google's services. [Link to Google's Gemini API ToS]

8. Data Retention

We retain your data as described in our Privacy Policy:

  • Data is stored in MongoDB for 12 months.
  • Data is stored in Cloudflare R2 indefinitely unless a deletion request is received. The raw data is stored for a maximum of 3 months.
  • You have the right to request deletion of your data as described in our Privacy Policy.

9. Disclaimer of Warranties

THE SITE AND SERVICE ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE OR SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SITE OR SERVICE; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SITE OR SERVICE; (C) ANY CONTENT OBTAINED FROM THE SITE OR SERVICE; OR (D) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT. IN NO EVENT SHALL OUR AGGREGATE LIABILITY EXCEED THE AMOUNT YOU PAID US, IF ANY, IN THE PAST SIX (6) MONTHS FOR THE SERVICE GIVING RISE TO THE CLAIM.

11. Termination

We may terminate your access to the Site and Service at any time, with or without cause. You may terminate your account at any time by contacting us at iqbal@iqbala.com. Upon termination, all licenses and rights granted to you under these ToS will immediately terminate. If we terminate your account without cause, we will refund you a pro-rata portion of your subscription fee for the unused portion of your subscription period.

12. Governing Law

These ToS shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law principles.

13. Dispute Resolution

Any dispute arising out of or relating to these ToS shall be resolved by binding arbitration in accordance with the rules of the London Court of International Arbitration (LCIA). The venue for any such arbitration shall be London, England.

14. Changes to These ToS

We may update these ToS from time to time. We will post any changes on the Site and notify you by email. Your continued use of the Service after the effective date of the revised ToS constitutes your acceptance of the changes.

15. Entire Agreement

These ToS constitute the entire agreement between you and MILD FRENZY LIMITED relating to the Site and Service and supersede all prior or contemporaneous communications and proposals, whether oral or written.
